Loyalty Program Terms and Conditions

These terms and conditions govern L&H Y Trading Inc. and its subsidiaries and affiliates (collectively, “Pawsync”, “our”, “us” or “we”) the Pawsync Loyalty Program (the “Program”).
This Program is operated by Pawsync and subject to the specific Terms and Conditions provided below as well as the Terms of Use, which can be found at https://pawsync.com/pages/terms-of-use, incorporated here by reference (collectively with these Program Terms and Conditions, the “Terms”). Defined terms from the Terms of Service not otherwise defined below are incorporated here by reference.
BY ACCEPTING THESE TERMS, AS DETAILED IN THE TERMS OF USE (https://pawsync.com/pages/terms-of-use) AND INCORPRATED HERE BY REFERENCE, BINDING ARBITRATION, AND CLASS ACTION WAIVER BELOW, YOU AGREE TO RESOLVE ANY DISPUTE IN ANY WAY ARISING FROM OR OUT OF THESE TERMS, OUR PRIVACY POLICY, DATA SECURITY, OR DATA PRIVACY THROUGH BINDING ARBITRATION OR SMALL CLAIMS DISPUTE PRODURES, UNLESS OTHERWISE PROVIDED BELOW, AND YOU AGREE TO WAIVE YOUR RIGHTS TO PARTICIPATE IN A CLASS ACTION SUIT.
BY ACCEPTING THESE TERMS, YOU ALSO AGREE TO OUR PRIVACY POLICY, WHICH CAN BE FOUND AT https://pawsync.com/policies/privacy-policy, WHICH IS INCORPORATED INTO THESE TERMS BY REFERENCE AND MAY BE UPDATED OCCASIONALLY.
Eligibliity. Participation in the Program is limited to natural persons residing in the United States, and are at least eighteen (18) years of age. By submitting an application, you confirm that you are at least eighteen (18) years of age. No business entities, organizations, or groups may register for the Program or earn Points (as set forth below) in the Program. Program accounts are limited to one per individual account and multiple or duplicate accounts may be terminated by Pawsync.
Program Overview. Pawsync’s Loyalty Program is a customer loyalty program that allows Members to receive and redeem points (“Pawsync Points”) for Rewards on an individual basis. A Member can receive Pawsync Points through qualifying purchases and other actions/opportunities that may be presented. There is no fee or cost to join and participate with the Program. Membership is personal and non-transferable. Pawsync Points, Rewards, and/or any other benefits may not be gifted, purchased, sold, bartered, brokered, or otherwise transferred. Points, Rewards, and/or any other benefits received as a result of participation in the Program have no cash value, are not redeemable for cash, gift certificates or gift cards, are purely promotional, and do not constitute property of any participant or Member. No portion of any payment for purchases qualifying for the Program, or any Pawsync Points, Rewards, and/or any benefits constitute consideration paid for any of the foregoing.
Joining. To participate and become eligible to receive Pawsync Points, Rewards, and/or any other benefits of being a Member, individuals must enroll and become a Member of the Program (“Member”). Pawsync reserves the right to limit participation and enrollment at any time.

Upon sign-up, you may be required to provided the requested information, which may include but are not limited to, name, password, e-mail address, and phone number. You agree to provide true and accurate information, and to ensure that the information you provide is true and accurate. Communications with you will be made using the most recently provided contact information you provide.
Pawsync Points and Rewards. Pawsync is under no obligation to provide Members with a specified number of Pawsync Point earning opportunities or special offers.
Pawsync Points are automatically tracked at the time of the qualifying purchase, transaction, or activity. Pawsync Points are only credited to one (1) Member’s account. Points will be credited to the Member’s account upon completion of the qualifying transaction or activity, and may take up to 24 hours to be credited. Pawsync is not responsible for, or liable to, any Member, person, or entity, in any way for losses, costs, or expenses incurred by error or delay in crediting Pawsync Points to a Member’s account.
You will receive Pawsync Points for qualifying purchases, transactions, or activities on Pawsync’s website at https://pawsync.com/. Purchases or transactions made on other purchase platforms are not qualifying purchases and will not count towards earning Pawsync Points. Purchases placed by or on behalf of groups, organizations, and other business entities will not generate qualifying purchases or earn Pawsync Points. No Pawsync Points are earned for any amount paid in delivery fees, surcharges, sales, or any type of taxes.
You can redeem Pawsync Points for available Rewards, including discount codes. When you have earned a minimum of 500 Pawsync Points, you can redeem them for a $5 discount code, but you can also redeem points in increments of 100 above that (e.g., you can redeem 600 points for a $6 discount code, or 700 points for a $7 discount code). You must have a minimum of 500 Pawsync Points to be able to redeem for a discount code. Discount codes cannot be applied to any past purchases. Discount codes cannot be used for purchases that total an amount less than the value of the code. The sum total of the purchase, after the discount code is applied must exceed $1. Each discount code is only redeemable once and is applied on all products in the order. The discount is split between products so that the discount share per product remains the same for all products in the order. In the case of a return, the discount advantage received through the Discount code (i.e., the value of the discount code) expires. Only the amount paid for the product will be refunded, not the savings from the discount code.
Changes, Termination and/or Removal from the Program. You may cancel your membership at any time through contacting our customer service team at: support@pawsync.com.
Please note that if you cancel your membership, you will only be able to purchase products using the guest checkout.
If you cancel your membership, any Pawsync Points, Rewards, and/or any benefits are automatically cancelled and will no longer be available for redemption. Pawsync reserves the right to suspend or terminate, at its sole discretion, any Membership if Pawsync believes that the Member has violated any of these Terms or applicable law, or otherwise acted in a manner harmful to Pawsync’s interests. Such violations may include, but are not limited to: abnormally frequent rate of returns, behavior demonstrating clear intent to resell our products, or the creation of multiple accounts by previously suspended users. If your Membership has been suspended or terminated, and you believe it was in error, please contact our customer service team at support@pawsync.com.
Pawsync reserves the right to cancel Membership if the Member’s account remains inactive for a period of two (2) years or more. If no qualifying purchase or activity eligible for Pawsync Points is completed within two (2) years after initial registration, Pawsync reserves the right to cancel your account. You understand and agree that any cancellation results in the forfeiture of all Pawsync Points, Rewards, and/or any benefits of participation in the Program.
Pawsync may, in its sole discretion, terminate, alter, limit, suspend, or modify the Program and/or Terms and Conditions at any time, in case of changes to applicable laws, changes in services provided by Pawsync, or introducing new services. Pawsync will attempt to notify you of any such change at https://pawsync.com/, via email, or a combination thereof. If you do not accept the changes, you have the right to cancel your membership. Pawsync reserves the right to make minor changes to the Program and its Terms and Conditions without providing you with prior notification, provided that these changes do not materially affect the membership in a negative way. Limitation of Liability. Pawsync shall not be liable for any system failure or malfunction of the Program or any consequences thereof. Pawsync accepts no liability for any loss or damages arising from suspension, variation or termination or in any other way relating to the Program, except for any liability which cannot be excluded by law.
Applicable Law and Jurisdiction. As set forth in the Terms of Use, these Terms are governed by and construed in accordance with the internal laws of the State of California without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the federal courts of the United States or the courts of the State of California in each case located in Orange County, California. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
The invalidity or unenforceability of individual contractual provisions shall not affect the validity of the remaining contractual provisions. In such case, the ineffective or unenforceable provision shall be replaced by the parties by an effective or practicable new provision.
